Recent Electronic Discovery Decisions

Zubulake Court Allocates 75% of E-Discovery Costs to Producing Party...shifts 25 percent of the restoration costs to plaintiff.

Six weeks after setting forth a revised test for determining how electronic discovery costs in a gender discrimination suit should be allocated, a federal judge has ordered the defendant to bear most of the expense of restoring data requested by the plaintiff. But U.S. District Judge Shira A. Scheindlin, (S.D.N.Y.) also shifted 25 percent of the restoration costs to plaintiff Laura Zubulake because she has been unable to show that the material she seeks contains direct evidence of discrimination.
