Q. In my requests for production, I've asked the other side to produce all their electronic documents. I expected them to print the stuff out. Instead, they've sent me CDs full of data. HELP! What do I do now?

A. There are a variety of tools that you can use to mine the data that you've been given. In fact, you may already own software which can delve into the zeros and ones of electronic discovery. Programs like Summation and Concordance have the ability to handle "e-docs" already built in.

SDNY Revisits, Revises Rowe Standards for E-discovery Cost Allocation: New Seven-Factor Test to decide who pays for Electronic Discovery

In a high-stakes employment discrimination case, a federal judge this week proposed solutions to two pressing problems of modern litigation: the extent to which inaccessible electronic data is discoverable and who should pay for its production. Zubulake v. UBS Warburg, 02 Civ. 1243 (SAS) (S.D.N.Y., decided May 13, 2003).

Summation Tip of the Month

How can I create a Lookup Table from existing data?

There may be an occasion where you have an existing database and you wish that you could take one of the fields that already has data in it and create a look-up table out of that data. It is possible to do that in Summation. It takes a few steps, but compared to the time it would save on re-entering that data in a look-up table it is well worth it.
