An attorney asks...

Q. I'm working on a case where there is the potential for involvement by several 3 letter government agencies. My client has electronic files on his computer system. Is there a way for me to find out what the government's guidelines are for discovering electronic data? I need to know what to anticipate.

A. In April, 2004 the U.S. Department of Justice published a report entitled "Forensic Examination of Digital Evidence: A Guide for Law Enforcement." While the title suggests that the report is for criminal law, the procedures and principles discussed are equally applicable to civil litigation. It discusses issues like "Presenting Digital Evidence in the Courtroom" and using high technology in investigations.

For Everything Else, There's Spoliation Sanctions

The purveyor of a web site that parodied MasterCard's "Priceless" ad campaign was sanctioned with an adverse inference for failing to retain any e- mails for four months after a copyright and trademark infringement case was filed against it. The court relied heavily on Residential Funding Corp. v. Degeorge Funding Corp., 306 F.3d 99(2d Cir. 2002) in finding spoliation and fashioning an appropriate remedy. MasterCard International, Inc. v. Moulton, 2004 WL 1393992 (S.D. N.Y., decided June 22).
