A. In
April, 2004 the U.S. Department of Justice published a report entitled
"Forensic Examination of Digital Evidence: A Guide for Law
Enforcement." While the title suggests that the report is for criminal
law, the procedures and principles discussed are equally applicable to civil

purveyor of a web site that parodied MasterCard's "Priceless" ad
campaign was sanctioned with an adverse inference for failing to retain any
e- mails for four months after a copyright and trademark infringement case
was filed against it. The court relied heavily on Residential Funding Corp.
v. Degeorge Funding Corp., 306 F.3d 99(2d Cir. 2002) in finding spoliation
and fashioning an appropriate remedy. MasterCard International, Inc. v.
