An attorney asks...

Q. The party on the other side of my lawsuit has a cell phone. He uses it to send and receive emails and text messages. I feel that these communications may be relevant to our case. How can I get hold of these messages? Do I physically have to take possession of the phone, or is there a less burdensome way for me to find the information I'm looking for.

A. One way to retrieve information stored on a cell phone would be to copy the SIM card. (This is the memory card that stores a variety of information.) An alternate way to retrieve the contents of emails and text messages is to contact the cell phone company directly. These messages are saved on servers and may be discoverable. This issue came up recently in the Kobe Bryant case, where the defense attorneys subpoenaed AT&T Wireless Communications Inc., seeking the messages.

Provider Ordered to Identify Subscriber Who Sent Fake E-Mails

A victim of forged e-mail has won the first round in his effort to unmask the identity of and sue the person responsible for sending a derogatory Christmas Eve message to his neighbors. The Maine Superior Court May 12 ordered Time Warner Cable to furnish information related to the identity of the person who established the e-mail account.
