This newsletter is designed to help the busy Litigation Professional develop an understanding of some of the issues associated with Digital Discovery.

Some estimate that over 90% of Corporate Data exists electronically. "Because of their ubiquitous nature, documents stored in electronic form... should be specifically targeted by counsel in developing their discovery plans. Failing to do so may not only prejudice their case, but may also constitute malpractice." Michael R. Overly: California Continuing Education of the Bar (1998 3d Ed), Civil Discovery Practice 3rd Ed., Vol.2, §8.24, p. 711.

·  "PST...what's in that file?"

PST files are "Personal File Folder" files created by Microsoft Outlook. Beware! These files can contain far more than archived emails.

The unsuspecting attorney may be producing his client's calendar, contact database, viruses and much more!

·  Meta Data...the data behind the data

Most electronic files have, as part of their profile, a variety of data. This data can help authenticate an electronic file, and give you clues that the printed version of the document conceal.

Producing electronic files without understanding meta data and its implications could be embarrassing at best.

·  Summation Tip of the Month

QUESTION: How Do I stamp Bates Numbers on images using my Summation database? ANSWER: You can add your own document number stamp, as in a Bates-stamp, to an image. This is especially helpful for those documents that have been stamped after they were scanned. Summation stamps the image with the image tag. The stamp can be removed at any time, and you can choose to hide or display existing stamps while viewing and printing images. You can also change the point size of the stamp.
