Judge Chastises Party for Inadvertent Erasure of E-mail Backup

Calling sanctions "premature," a U.S. District Judge from New Jersey is nonetheless highly critical of a defendant whose restoration efforts resulted in the erasure of critical e-mails it was under order to produce in discovery. While acknowledging that the erasure was inadvertent, District Judge Denise said that UnumProvident had ill-equipped and unsupervised people making critical decisions about the preservation. The issue of sanctions was reserved until the extent of the loss, the possibility of retrieval, and the resulting prejudice to the plaintiffs are determined.

Summation Tip of the Month

You can check the integrity of your database using the "Verify Document Numbers Utility" which detects missing, overlapping (duplicate), and blank document numbers.

The Document Verification dialog generates a report of all document numbers contained in the current set of database records, reporting errors and other data inconsistencies.
