Q. My client uses Microsoft Outlook for her email. She has given me a copy of her email box on CD. Before I produce this CD to the other side, is there anything that I need to know. I want to avoid inadvertently disclosing more than was requested.

A. We urge you to proceed with CAUTION! PST files are "Personal File Folder" files created by Microsoft Outlook. Beware! These files can contain far more than archived emails. The unsuspecting attorney may be producing his client's contact database, calendar, to-do lists and much more!

E-Mail Disclosed by Means of 'Patently Unlawful' Subpoena Violates Stored Communications Act.

Use of a "patently unlawful" subpoena to gain access to e-mail stored by an Internet service provider constitutes a violation of a federal electronic privacy statute, the Ninth Circuit has ruled. The district court thus erred in dismissing a claim under the Stored Communications Act (SCA), 18 USC '2701 et seq.

Summation Tip of the Month

QUESTION: How Do I stamp Bates Numbers on images using my Summation database?

ANSWER: You can add your own document number stamp, as in a Bates-stamp, to an image. This is especially helpful for those documents that have been stamped after they were scanned. Summation stamps the image with the image tag. The stamp can be removed at any time, and you can choose to hide or display existing stamps while viewing and printing images. You can also change the point size of the stamp.
